I’ve been charged with a crime, what should I expect?
After you have been arrested a document will be filed stating the charges against you, i.e. a summons or complaint in Municipal Court; an indictment or accusation in Superior Court.
The first time you appear in court you will be informed of the charges against you. This is called a “First Appearance.”
An “arraignment” date will then be scheduled at which time you will enter a plea of guilty or not guilty. “Discovery” (a copy of the state’s file containing the evidence against you) will be provided to your attorney. If you are in custody a “Bail Review Hearing” date will be scheduled at your arraignment.
If you plea not guilty, a date would then be scheduled for a status or pre-trial conference at which time the Prosecutor may make an offer to your attorney to settle your case. If you decided to retain Francis as your attorney, he will negotiate on your behalf to obtain the best deal for you.
There may be pretrial conferences to discuss various motions such as a motion to suppress evidence.
If your case has not been resolved it will be scheduled for trial. You will be tried without a jury in Municipal Court, and the judge will determine if you are guilty. Most cases in Superior Court are tried before a jury of 12 jurors who will decide if you are guilty or not guilty.
Lastly, if convicted, a sentencing hearing will be scheduled.
